Spec Agreements
(II) Fees. The agreement is expected to determine the royalties that will be paid to the producer for the master`s degree to be produced under the new record agreement. The territory of this agreement is “the world and its solar system.” Although it is often possible to limit the scope of recording agreements, this is generally not the case for production contracts, as the production company will repeat that it must be able to offer these rights to a third-party record company. The contract also sets out specific “delivery requirements.” If you pass your master`s records and the company decides that these requirements are not met, they will refuse to accept the recordings. The typical requirement is that masters must be “technically and economically satisfactory.” A recording is “technically satisfactory” as long as it sounds like a professionally produced work, unlike something you recorded on a 4-track in your bedroom. The standard agreement contains (at point 17.2.2) a provision that gives the artist the right to reallocate the master in case the royalties due and due are not paid. While this clause may seem reasonable to most people, it may be extremely difficult to convince production companies to admit it, but it is always worth asking for. The 360 agreement should be a win-win situation for both the artist and the label.
The artist receives more money in advance, but more importantly, he is given time to develop and establish himself as a fixed Innisin in the world of music. In return, record companies receive money (then a few) because of declining album sales and have a greater interest in helping their artists succeed. The financial support of the label in advance can create a much more timeless relationship between the artist and the label. Traditionally, artists have been put under pressure to publish albums under contractual provisions. The 360 agreement allows the artist to take the time to write new material, because the label generates revenue from several sources of income, not just from the sale of albums. As part of a 360 agreement, labels are encouraged to create a mutually beneficial relationship with their artists by helping in all aspects of their careers, because the more money the artist earns, the more money the label will earn.
